KIM DAVIS AND THE LAW




“Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof;” The 1st Amendment,

In my mind that is succinct; you and I and each and every one of us has the unmitigated right to worship if we wish as we wish. We cannot be forced to follow another’s religious beliefs or have it forced down our throat.

Likewise the law is the Law, and despite one’s personal convictions a holder of a civic office must follow the dictates of that office.

Yes a baker can refuse to make a cake for a same sex couple marriage. There is no law forcing him to do so.

However, County Clerk Kim Davis an elected official, was sworn in to fill a position with defined duties and responsibilities. Either she conforms to the law with her name and title on the marriage certificates or she resigns her position. Because it is an elected position she cannot be “fired”.

By refusing to issue the certificate because of her religious convictions she is violating the law. She is not deprived of her convictions but is forcing her convictions upon the applicants.

This of course will be material for the politicians especially those like Cruz and Huckabee who are going to Rowan County and speak in support of her.

Only three Republicans have spoken against her stance.Gov. Chris Christie of New Jersey, Senator Lindsey Graham of South Carolina and Carly Fiorina, the former Silicon Valley executive, said that as a government employee Ms. Davis was obligated to carry out the law, despite personal religious objections.

  1. My adult class had a lot to say about this issue and unanimously were in favor of her current status of being jailed. They feel that she needs to separate church and state as a government employee and she took an oath and is not fulfilling it. As an elected official in my city I pledged to uphold the laws of the Federal government, State, and my City. Ms. Davis is also practicing selective Christianity. I am a Christian and know that she issues marriage licenses to divorced people. Jesus said that is adultry. Jesus said, "Render unto Caesar what is Caesar's." He also spoke to his followers who worked for the government authority and their duty to fulfill their jobs. She isn't doing this.

    John Kasich, who opposes gay marriage, thinks a Kentucky clerk should issue same-sex marriage licenses despite her religious beliefs.

    Rowan County clerk Kim Davis is sitting in jail indefinitely after defying court orders to issue marriage licenses to same-sex couples. Conservatives have cheered her for standing on her personal religious beliefs, saying the government is persecuting her.

    Even though Davis personally opposes same-sex marriage, she's a government employee, Kasich told ABC's "This Week" on Sunday.

    "She's not running a church. I wouldn't force this on a church, but in terms of her responsibility, I think she has to comply," said Kasich, Ohio governor and a GOP presidential candidate. He doesn't think she should sit in jail, he said, but "I think she should follow the law."
