COUNCIL MEETING 10/5//09 Part 2

Although Council President Byrney announced that the Monarch Tax Abatement was dead, he added "for the moment". Councilwoman Carter clarified by telling what should have been evident, that when the Ordinance was not acted upon it became null and void. To reintroduce the plan would require a new Ordinance, which would have to go through the required two readings.

If the CO has been issued for the Senior Center and the terms for it to become City property are supposedly spelled out in the UCIA/Dornoch sales agreement, why according to City Administrator Dashields is the City now working with the developer to come up with a "transition date." By contract it has to be some time this month or else the developer will be in default.

One of the problems outstanding for the CO has been the insufficient number of parking spaces provided to meet the needs of the condo owners plus the users of the Senior Center. How did this slip through Planning Board and/or Zoning Board and the Council's approval?

Dashield had no answer to Mapp's question if all the terms of the Park-Madison project had been met and if the CO was unrestricted and not temporary. He will get back to the Council for next weeks meeting.

Councilor Storch voiced his opposition to Ordinance 2009-23 up for second reading and approval. The ordinance would permit the exceeding of the state tax increase cap by either 2.5 or 3.5%. Storch pointed out that the actual increase would be substantially more and that despite the State Cap increase (4%???) there are a number of exceptions granted by the State. we will learn how much the proposed property tax will be when the 2010 Budget is introduced next Tuesday.

Mr. White addressed the Council and public apologizing for in his excitement having misspoken about Assemblyman Green's knowledge of the Caribbean Fair at the last Council meeting. I for one found his statement at that time difficult to accept, and acknowledge that his retraction was without "arm twisting".

Monday is Columbus Day holiday so the Council meeting will take place on Tuesday.
