City Charter re: the Planning Board
Powers and
Duties
A. The
Planning Board shall follow the provisions of the Land Use Ordinance and shall
accordingly exercise its powers in regard to:
1. The City master plan
2. The
official map
3. The capital improvements program and
capital project review
4. Variances
and certain building permits in conjunction with subdivision and site plan
approval
5. Subdivision and site plan control and
review
6. Design standards
7. Stormwater management controls
8. Sign controls
B. The Planning
Board shall:
1. Participate in the preparation and
review of programs or plans required by the State or Federal law
2. Assemble data on a continuing basis as
part of a continuous planning process
3. Perform such other advisory duties as
are assigned to it by ordinance or resolution of the City Council.
C. The Planning
Board may adopt bylaws governing its procedural operations.
D. The Planning
Board shall perform such other advisory duties as are assigned to it by
ordinance or resolution of the City Council.
The powers of the Board are rather vague and broad. Since
the area occupied by the Muhlenberg campus is zoned as "Professional
Office/Medical" there can be no zoning objection.
If the Planning Board
approves the plans for the site that will in fact give JFK the right to abandon
the hospital property as buildings for medical use. However the “hospital” will then have to be rezoned for
other use.
The question is there a need for the “State” to approve the
move?
Once again JFK has Putinized Plainfield residents. Although
the Kenyon House contains a for profit operation; JFK has not paid taxes on the
site.
The new use will permanently remove the property from what should be a
taxable one. Why no attempt was ever made to collect taxes is a mystery that
only the former Mayor can answer.
