ROUTE 28.

Reading NJDOT Commissioner Simpson's letter to Assemblyman Green it ia obvious that the State is happy to deny any responsibility for State Highway 28 as it passes through Plainfield. In other words there is no State Highway within the city limits.

No one has ever produced the record of Plainfield assuming responsibility for Rt. 28 That is th? issue. not the State " the New Jersey Department of Transportation (NJDOT) did not take over jurisdiction of Route 28 in Plainfield."

There is a question; does the State or City Snow Plow the involved streets? If the State provides no maintenance then we should remove all identifying signs. However if the State wants to still designate those streets as part of the State system we should be able to charge "rent". If the State does the plowing etc. they are also accepting (admitting) some responsibility of ownership.

There are many legal questions here that some one could make an issue but cost and time would prevent that for happening. What is the "ownership' status of the remaining portion of Rt 28 in the City Borders. If the State has responsibility for any part of it; it may be worth a suit to recover the costs spent do far on repaving. It may be difficult for the State to prove that the City has responsibility other the years of acceptance.
